Terms of Business & Conditions of Sale

General
These terms and conditions (the Terms) govern the users (you or your) use of this website (the
Website or Site) and your relationship with this Website (we, our, or us).
Please read them carefully as they affect your rights and liabilities under law.
If you do not agree to these Terms, please do not access
or use the Website.
This Website reserves the right to change these Terms without prior notice at any time.
These Terms have been carefully written in plain English for clarity. If you have any query, please contact us prior to placing your order, as placing an order with us automatically implies that you agree with the Terms (both shown and linked to) below.

1.
Format of the Contract
1.1 These Terms of Business and Sale (the Terms) apply to all goods supplied by the Website (the Supplier).
1.2
No contract exists between you and the Site for the sale of any goods
until the Site has received and accepted your order, and the Site has
received payment in full in cleared funds. Despatching the goods and
supplying you with package tracking information shall be considered our
acceptance of the contract to supply. Once the Site provides that
despatch information, there is a binding legal contract between us.
1.3
We may change these Terms at anytime in relation to any future orders,
without notice to you .
1.4 Refusal to serve
We reserve the right to refuse to supply any order placed, without giving a justification.

Placing an order via our web site does not constitute a contract until goods are paid
in full by cleared funds and despatched from our premises.

1.4.2
We reserve the right to cancel any sale after charging and prior to the goods leaving our premises, in which case a full refund of any amounts
already charged will be made.

1.4.3
We reserve the right to refuse to accept further orders from you should you repeatedly return
items, whether for exchange, refund, or replacement.
2.
Description & Price of Goods
2.1 The description and price of the goods you order will be as shown on the
Site at the time you place your order.
2.2 Every effort is made to ensure that the
prices shown on the Site are accurate at the time you place your order.
If an error is found, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order.
In such cases, if you fail to reply within seven days, the order will be treated as cancelled and any pre-payments or deposits
will be handled as per our Refunds Policy.
2.3
Our prices for unpurchased (order not confirmed) goods and services, are subject to change without notice.
2.4
Substitution
/ Availability
It is possible
that, from time to time, products may be incorrectly listed and are no longer available, have had a specification change, or are no longer
available at the listed price. It is also possible for an incorrect price to be entered during the ordering process.

2.4.1 We reserve the right to refuse to serve in these instances.

2.4.2
We reserve the right to substitute merchandise of equal or better quality if the merchandise requested, has been sold out.

2.4.3 We reserve the right to substitute
brands, and as such photographs are only a representation of the product sold
(See clause 10 below).
2.5
Tax
All prices are displayed exclusive of VAT and other taxes.

2.5.1
Customers
outside of Thailand will pay the price displayed, but may also have to pay
import duties, purchase tax, GST, or VAT to the Customs authorities in their own
country.

2.5.2
Customers
within Thailand will currently not be charged VAT, but in the future may have to
do so. When this happens, the VAT rate and amount will be displayed in
product descriptions and during the checkout process. No other
notification of this change will be made.

3.
Payment

3.1 Payment for the goods and delivery charges can be made by any method offered to you during checkout on the
Site at the time you place your order. Payment shall be due before the
despatch date, and time for payment shall be a fundamental term of this agreement, breach of which shall entitle
us to terminate the contact immediately.
3.2
No goods will be despatched until cleared funds are received, through
online services, manual offline payment methods, or through normal banking
channels manually or electronically.
3.3
Payments shall be made by you without any deduction whatsoever, unless you have a valid court order requiring an amount
equal to such deduction to be paid to you, by us, immediately.

4.
Delivery

4.1 The goods you order will be delivered to the address you give when you place your order. If using
PayPal to pay, we will only deliver to the registered PayPal address held on file by them. This
will be determined from the PayPal payment details page on the PayPal
website. There are no circumstances that will override this, it is your responsibility to ensure your address is correct
and current.
4.2
If you pay with PayPal and you are not located in a PayPal Seller
Protection Policy (SPP) country, Postal Insurance is a compulsory
surcharge when it is available to your country. If it is not available to your country at the time of purchase, we reserve the right to refund and request an alternative payment method.
4.3
If signed-for delivery cannot be made to your address at the first
attempt, and your delivery uses the post office, your postal officer
should leave an attempted delivery card (but might not) and you will have
to collect from the postal collections office. You may have to visit
them more than once - including at the expiry of the stated normal transit
period. You have to certify on the Late delivery report form that
you have visited your postal collections office.
4.4
Every effort will be made to despatch the goods as soon as possible after your order has been accepted.
However, we will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in despatch. Whenever possible,
we will inform you as soon as possible. Transit time between despatch and delivery is the liability of the postal service you instruct us to use, the Customs service in your country, and yourself (collections from depot).
4.5
Upon receipt of your order you will be asked to sign for receiving the goods in good condition, you must
check the delivery before signing - if it is damaged, state this next to your signature.
Failure to do this may affect any insurance or warranty claims that you make thereafter. No
claims for goods missing from a consignment will be accepted once 72 hours have passed from time
& date of signing for goods, it is your responsibility to check the
package to ensure all items are correct and present.

5
Risk & Title
5.1 The goods are at your own risk from the time of delivery.
5.2
Ownership of the goods shall not pass to you until we have received in full (in cash or cleared funds) all sums
due to us in respect of:

We shall be entitled to recover payment for the goods even though ownership of the goods has not passed
to you from us.
5.4
If for any reason whatsoever after despatch of the goods, you reverse or
reclaim your payment, then the title of the goods remains ours and the
risk and liability becomes yours immediately upon such reversal or reclaim
of payment. Unless the goods are returned to us by the delivering
agent or you, then you remain liable for payment for them until such time
as the delivering agent admits liability for loss and compensation, or
until the goods are returned to us.

6.
Cancellation
6.1 Except in the case of faulty, misdescribed, or mis-manufactured
bespoke goods, if you change your mind and request cancellation after the goods have been delivered to you, you will be responsible for returning the
goods to us at your own cost, and in undamaged, unused, resellable
condition. All returned goods are carefully inspected on receipt for
signs of use or misuse and if found, no refund will be given.
6.2
The goods must be returned to the address shown within the contact
us section of the Site. You must take note that return of non-faulty goods incurs a restocking charge of 10%.
6.3
In the case of faulty or misdescribed goods we may, after receiving notification
in accordance with clause 4.5, ask you to return the goods yourself and refund you the reasonable postage
costs authorised by us, once the goods have been received by us.
6.4 Bespoke goods made to your
specifications (such as hand-painted or customised products) cannot be returned unless
mis-manufactured. It is therefore important you make absolutely sure that the item matches the
correct dimensions and specifications you require, and which must be fully specified before production begins.
6.5 Once you have notified
us that you are cancelling the contract, we will refund or re-credit you within 30 days
(of the goods return date, or cancellation date if before despatch) for any sum that has been paid by you or debited
from your credit or debit card for the goods.
6.6 Except in the case of faulty
or misdescribed goods, if you do not return the goods as required, we may charge you a sum not exceeding the direct costs of recovering the goods.

Change
of Mind
In the event of
"Change of Mind", postage costs are not refundable. We do not refund postage in either
direction, and any product-price refund may be charged a 10% restocking and handling
fee.

7. Warranty
7.1 Products displayed on the Site are provided "as is" without warranty of any
kind either expressed or implied (unless specifically stated in a product
description) other than a guarantee to replace or exchange goods that are
defective or damaged on delivery, provided we are informed within 7 days
of delivery that goods are defective, or informed within 24 hours of
delivery if they were damaged in transit as per clauses 4.5 and 7.3.
7.1.1 Products
returned under clause 7.1 must initially be returned at your cost.
If we validate the defect or damage occurred before the goods were despatched to you, then
we will refund the postage cost of returning the goods provided it is
reasonable and followed our authorised methods.
7.2 If there is any defect
in returned goods arising from fair wear and tear, wilful damage, accident,
negligence by you or any third party, use otherwise than as recommended by the
manufacturer or us, failure to follow our instructions, or any alteration or
repair carried out without our approval, then we will not issue
replacement goods, refunds, or purchase credits.
7.3 If the goods we supplied to
you are damaged on delivery, you must notify us in writing, via email or fax, within 24
hours of delivery and then follow the requirements of our Returns
& Replacements Policy

Liability
Exclusion
Should
any product description state a product is fit for a specific purpose, and
it then prove to not be so, our liability shall be limited to refunding
the payment you made to us for that product, and upon receipt of returned
goods, any return postage costs approved by us.
In no event shall
the Site be liable for any special,
incidental, indirect, or consequential damages of any kind, or any damages
whatsoever arising from goods failing to meet your intended purpose if the Site did not specifically state, at the time of purchase, that the goods
will meet that purpose.

8.
Limitation of Liability
8.1 Subject to 8.2 below, if you are a consumer we shall not be liable to you for any loss or damage in
circumstances where:

8.1.1 there is no breach of a legal duty owed
to you by us or by our employees or agents;

8.1.2 such loss or damage is not a reasonably
foreseeable result of any such breach;

8.1.3 any increase in loss or damage resulting
from breach by you of any term of this contract.
8.2
Nothing in these conditions excludes or limits our liability for death or personal
physical injury caused by our negligence or fraudulent misrepresentation.

will take all reasonable precautions to keep the details of your order and
personal information secure, but unless we are negligent, we shall not be
held liable for unauthorised access to information supplied by you.

10.1 Product images are for illustrative purposes only and may differ from the actual product.

We are not responsible, and will not accept returns, or refund claims, for reasons of colour variance due to computer
colour settings or variation of output device performance, including but not
limited to monitors, printers, plotters, or any other video device.
10.3
We cannot accept responsibility for any third party information or links
within our site, nor for the accuracy of the information they
contain. We shall not be responsible for advertising errors that
fall beyond our control.

subject to the Laws of Thailand and the Thai Courts shall have jurisdiction in
respect of any dispute arising from the contract.

Based in Thailand, we use European, and American, Distance Selling Regulations
(and other similar, consumer protection legislation), as the
framework for our business operations and policies, but we do remind customers
